Acceptance of Terms
By accessing or using the services provided by Premex AB at https://crafty.premex.se ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Service.
You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under the required age, you may not access or use the Service under any circumstances.
Definitions
For the purposes of these Terms:

"Service" refers to the website, applications, and any related services operated by Premex AB.

"User", "you", and "your" refer to the individual or entity accessing or using the Service.

"We", "us", and "our" refer to Premex AB.

"Content" refers to any text, images, data, software, or other material made available through or uploaded to the Service.

"Account" refers to the registered user profile created to access restricted features of the Service.
Description of Service
Crafty is a construction project management platform available as a web application and mobile app (Byggappen). It enables construction teams to manage projects, track time via geofencing, communicate through in-app chat, share photos and documents, and coordinate on-site activities. The Service is a project management tool and is not a substitute for professional construction safety assessments, engineering judgments, or regulatory compliance. Users must not rely on the Service for safety-critical decisions. Location-based features such as geofencing depend on GPS accuracy and network conditions, and Premex AB does not guarantee the precision of location data.
The Service is provided as a software-as-a-service (SaaS) platform. You access the Service over the internet; no software installation on your local device is required beyond a compatible web browser. We are responsible for hosting, maintaining, and updating the platform. You acknowledge that the availability, features, and performance of the Service may vary depending on your subscription plan and internet connectivity.
We offer a free tier of the Service with limited functionality. Free-tier users are subject to the same Terms unless otherwise stated. We reserve the right to modify, limit, or discontinue the free tier at any time without prior notice. Upgrading to a paid plan may be required to access additional features or higher usage limits.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
User Accounts
Registration
To access certain features of the Service, you must create an account by providing accurate, current, and complete information. You agree to update your account information promptly to keep it accurate and complete.
Account Security
You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You agree to:
- Create a strong password and keep it confidential
- Not share your account credentials with any third party
- Notify us immediately at contact@premex.se if you suspect any unauthorised access to or use of your account
- Accept responsibility for all activities that occur under your account
We shall not be liable for any loss or damage arising from your failure to maintain the security of your account credentials.
Account Accuracy
You represent and warrant that all information you provide during registration and while using the Service is truthful, accurate, and complete. Providing false or misleading information is a violation of these Terms and may result in immediate termination of your account.
Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You specifically agree not to engage in the following prohibited activities:

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this section, including removing content, suspending or terminating accounts, and reporting to law enforcement authorities.
User Content
Content Ownership
You retain all ownership rights in the content you submit, post, or display through the Service ("User Content"). By submitting User Content, you grant Premex AB a non-exclusive, worldwide, royalty-free, sublicensable, and transferable licence to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content solely in connection with operating, providing, and improving the Service.
Content Representations
You represent and warrant that:
- You own or have the necessary rights and permissions to submit the User Content
- The User Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party
- The User Content does not contain unlawful, defamatory, obscene, or otherwise objectionable material
Content Removal
We reserve the right, but have no obligation, to review, monitor, or remove User Content at our sole discretion and for any reason, including content that we believe violates these Terms or may be harmful to other users or third parties.
Digital Services Act (DSA) Compliance
In accordance with the EU Digital Services Act (Regulation 2022/2065):
Reporting Illegal Content: If you believe that any User Content on the Service is illegal, you may submit a notice through our designated reporting mechanism by contacting contact@premex.se. Your notice should include: (a) an explanation of why the content is considered illegal, (b) a clear indication of the location of the content, and (c) your name and contact details.
Transparency in Content Moderation: We apply content moderation practices as described in this section. Where content is restricted or removed, we will provide the affected user with a clear and specific statement of reasons, including the applicable grounds and, where applicable, the legal basis for the decision.
Right to Appeal: If your content is removed or your account is restricted, you have the right to appeal the decision. Appeals may be submitted by contacting contact@premex.se within thirty (30) days of the moderation action. We will review your appeal and inform you of the outcome without undue delay.
Intellectual Property
All content, features, functionality, graphics, designs, trademarks, logos, and software comprising the Service are the exclusive property of Premex AB or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You may not:
- Reproduce, distribute, modify, or create derivative works of any part of the Service
- Reverse engineer, decompile, or disassemble any software used in the Service
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices
- Use Premex AB's name, logo, or trademarks without our prior written consent
Open Source Components
The Service may incorporate open source software components. Each open source component is subject to its own licence terms, which can be found in the documentation or source code repositories associated with the respective components. Nothing in these Terms limits your rights under, or grants you rights that supersede, the terms of any applicable open source licence.
Subscriptions and Payments
Subscription Plans
Access to certain features of the Service requires a paid subscription. The following subscription plans are available:

Billing
Subscription fees are billed monthly. By subscribing, you authorise Premex AB to charge your chosen payment method on a recurring basis until you cancel. All fees are quoted in the currency displayed at the time of purchase and are exclusive of applicable taxes unless otherwise stated.
Price Changes
We reserve the right to change subscription fees at any time. We will provide you with reasonable advance notice of any fee changes. Your continued use of the Service after a fee change takes effect constitutes your agreement to the new fees.
Cancellation
You may cancel your subscription at any time through your account settings or by contacting us at contact@premex.se. Cancellation takes effect at the end of the current billing period. You will continue to have access to the Service until the end of your paid period.
No Refunds
All subscription fees are non-refundable. You will not receive a refund for any unused portion of a subscription period. In extraordinary circumstances, refunds may be granted at the sole discretion of Premex AB.
Right of Withdrawal
Under the EU Consumer Rights Directive (2011/83/EU), you have the right to withdraw from a subscription within 14 days of purchase without giving any reason. To exercise this right, you must inform us of your decision by a clear statement (e.g., by email to contact@premex.se). Upon withdrawal, we will reimburse all payments received from you without undue delay and no later than 14 days from the day we are informed of your decision.
Please note that if you have requested that the service begin during the withdrawal period, you may be required to pay an amount proportional to the services provided up to the point of withdrawal.
Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
- Premex AB shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.
- Premex AB shall not be liable for any damages arising from (a) your use of or inability to use the Service, (b) any unauthorised access to or alteration of your data, (c) statements or conduct of any third party on the Service, or (d) any other matter relating to the Service.
Our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the total amount paid by you to Premex AB in the twelve (12) months preceding the event giving rise to the claim, or (b) 100 EUR.
Warranty Disclaimer
The Service is provided "as is" and "as available" without any warranty of any kind, whether express, implied, or statutory. Premex AB expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free
- The results obtained from the Service will be accurate or reliable
- Any defects in the Service will be corrected
EU Consumer Protection Notice: Nothing in this warranty disclaimer limits any mandatory warranty rights you may have under applicable consumer protection law, including but not limited to EU Directive 1999/44/EC on certain aspects of the sale of consumer goods and associated guarantees, and its national implementing legislation (such as the Swedish Konsumentköplag).
Indemnification
You agree to indemnify, defend, and hold harmless Premex AB, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable legal fees, arising out of or relating to:

Your violation of these Terms

Your violation of any rights of a third party

Any User Content you submit through the Service
This indemnification obligation will survive the termination of these Terms and your use of the Service.
EU Consumer Protection Notice: This indemnification clause does not apply to the extent that you are a consumer within the meaning of EU Directive 93/13/EEC on unfair terms in consumer contracts. Nothing in this section shall be construed to limit any mandatory consumer protection rights under applicable EU or national law.
Termination
Termination by You
You may terminate your account and cease using the Service at any time. If a notice period is required, you must provide at least 30 days of written notice to contact@premex.se. Upon termination, your right to access the Service ceases immediately, except for any remaining paid period.
Termination by Us
We may terminate or suspend your access to the Service at any time, with or without cause and with or without notice. Grounds for termination include, but are not limited to:

Non-payment of applicable fees

Extended period of inactivity

Request by law enforcement or government authority
Effect of Termination
Upon termination:

Your right to use the Service ceases immediately

We will retain your account data for 30 days after termination, after which it may be permanently deleted

Under GDPR Article 20 (Right to Data Portability), you may request an export of your personal data in a structured, commonly used, and machine-readable format before the retention period expires by contacting contact@premex.se

Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, limitation of liability, and dispute resolution
Suspension
We reserve the right to suspend your access to the Service, in whole or in part, under the following circumstances:

Suspected violation of these Terms or applicable law

Security concerns, including suspected unauthorised access

Required maintenance or updates to the Service

Non-payment of subscription fees after a reasonable grace period
We will make reasonable efforts to notify you before or promptly after any suspension and to restore access once the underlying issue has been resolved.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. Any legal action or proceeding relating to these Terms shall be brought exclusively in the courts of Sweden.
Dispute Resolution
All disputes arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may bring an action in the competent courts of Sweden.
EU Online Dispute Resolution
If you are a consumer in the EU/EEA, you may submit a complaint through the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr, as required under EU Regulation 524/2013.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.
Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, and any other legal documents or policies referenced herein, constitute the entire agreement between you and Premex AB regarding the Service. These Terms supersede all prior and contemporaneous agreements, proposals, representations, and understandings, whether written or oral, regarding the Service.
Force Majeure
Neither party shall be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond the reasonable control of that party, including but not limited to natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labour, or materials.
Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of all or substantially all of our assets. Any purported assignment in violation of this section shall be void.
Waiver
The failure of either party to enforce any provision of these Terms shall not be construed as a waiver of such provision or the right to enforce it at a later time.
Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you via email and a notice on our website at least 30 days before the changes take effect. Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the revised Terms.
If you do not agree with the revised Terms, you must discontinue your use of the Service before the changes take effect.
